STANDARD TERMS AND CONDITIONS OF SALE – Smoked Meats Orders


  1. These terms apply to all orders for smoked meats, BBQ products, catering, delivery, or pickup. By placing an order, the customer agrees to these terms and waives any conflicting standard terms they may have.
  2. Order Acceptance and Modifications Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order. Any changes to an order must be agreed in writing. All orders for perishable smoked meats are final once preparation begins.
  3. Payment Payments are due as specified at checkout or on the order confirmation (e.g., full payment upfront, deposit required for larger/custom orders). Invoices (if applicable) are payable within 7 days unless otherwise stated. Late payments may incur interest at 1.5% per month or the maximum allowed by law. We may suspend future orders or delivery for non-payment.
  4. Deposits and Pre-Payment For custom, large, or advance orders (e.g., catering, bulk smoked meats), a non-refundable deposit may be required at booking to secure your order and cover preparation costs. Deposits are typically 30–50% of the total and become non-refundable upon acceptance/preparation.
  5. Cancellation and Refund Policy

    • Cancellations must be made in writing (email or message).
    • For standard orders: Cancellations more than 48 hours before scheduled pickup/delivery receive a full refund minus any processing fees. Within 48 hours, no refunds due to perishable preparation.
    • For orders requiring a deposit: Deposits are non-refundable if canceled after preparation begins or within the timeframe specified in your order confirmation.
    • Repeat Cancellation Policy: If you have previously canceled an order with less than 24 hours' notice before the scheduled delivery/pickup time, we may require a non-refundable down payment (deposit) of up to 50% for any future orders to confirm and process in advance. This protects against repeated last-minute cancellations and associated losses (e.g., wasted food, labor, scheduling). This requirement will be noted on future order confirmations.
  6.  Delivery and Pickup Delivery/pickup times are estimates only. We are not liable for delays due to traffic, weather, or other uncontrollable factors. Customer must inspect goods upon receipt/pickup and report issues immediately (within 2 hours for temperature/quality concerns). Perishable items cannot be returned once accepted.
  7.  Food Allergies and Allergen Disclaimer Our kitchen handles common allergens including (but not limited to) wheat/gluten, soy, dairy, eggs, tree nuts, peanuts, fish, shellfish, and sesame—often through shared equipment, surfaces, utensils, smoke/wood processes, or ingredients like sauces, rubs, or marinades. While we take reasonable precautions to minimize cross-contamination, we cannot guarantee that any item is completely free of allergens or that cross-contact will not occur.
  8. It is the customer's responsibility to disclose any known food allergies or sensitivities before placing the order. Please inform us in writing (via order notes, email, or message) at the time of ordering so we can discuss options and attempt reasonable accommodations where possible (e.g., avoiding certain ingredients if feasible). Failure to disclose allergies in advance may limit our ability to accommodate safely.
  9. Customers with severe allergies assume the risk of consumption. We are not liable for any allergic reactions, adverse effects, or related damages arising from our products, including those due to undisclosed allergies, cross-contamination, or post-handover handling/storage. All food is provided "as is," and consumption is at the customer's own risk.
  10.  Claims and Liability Any claims for damaged, incorrect, or non-conforming goods must be reported in writing within 24 hours of receipt/delivery. We will replace or refund qualifying issues at our discretion. Our total liability is limited to the order value. We are not responsible for misuse, improper storage, consumption after handover, or allergic reactions (see Section 6).
  11. Force Majeure We are not liable for delays or failure to perform due to events beyond our control (e.g., supply shortages, natural disasters, government restrictions).
  12. Governing Law These terms are governed by the laws of the State of California and the United States. Any disputes shall be resolved in courts located in Los Angeles County, California.
